What Broadsight Connect Is
Broadsight Connect is an AI-powered voice and SMS service that helps businesses handle incoming calls and text messages. When someone calls or texts a Broadsight Connect number, our AI agent answers, triages the request, and routes it to the right person.
Using Broadsight Connect
Creating an Account
When you sign up, you provide a phone number and an email address. Your account is yours — don't share your login credentials. You're responsible for all activity under your account.
You must be at least 18 years old to create an account or use the service. If you use the service on behalf of an organization, you represent that you are authorized to bind it to these terms.
Free Trial
New organization accounts may receive a 14-day free trial with no credit card required. If you do not select a paid plan and add a payment method before the trial and any applicable grace window expire, your account will be deactivated and call and messaging handling will pause until a plan is activated.
Customer Compliance: Recipient Consent and Call Recording
When you upload, import, or enter phone numbers or contact records into Broadsight Connect — including residents, prospective leasing leads, and maintenance specialists or vendors — or direct Broadsight Connect to place calls or send messages on your behalf, you represent and warrant that:
- You have a lawful basis and have obtained all prior express consents required under applicable law (including the Telephone Consumer Protection Act (TCPA) and state equivalents) for Broadsight Connect, acting as your service provider, to call and text those individuals for service, maintenance, leasing, and operational updates;
- You will honor opt-out requests and will not re-enroll or message any individual who has opted out (including via STOP) unless that individual subsequently re-initiates consent directly; and
- You comply with all applicable federal and state call-recording and wiretapping laws in the jurisdictions where your properties and callers are located.
Acceptable Use
You agree to use Broadsight Connect for lawful purposes only. Specifically:
- Don't use the service to harass, impersonate, or deceive anyone
- Don't use the service for spam, scams, or unsolicited marketing, or to message purchased or rented lead lists
- Don't try to break, exploit, or reverse-engineer the service
- Don't use the service for emergency services (911, fire, police) — it is not a replacement for 9-1-1
Our Service
What We Provide
Broadsight Connect provides an AI-powered call and SMS handling service. The agent answers incoming calls, classifies issues, collects information, and routes requests to designated contacts. We strive for accuracy but the AI may make mistakes — always verify critical information.
No Emergency Services
Broadsight Connect is not a 9-1-1 service. If you have a genuine emergency, call 9-1-1 immediately. Do not rely on Broadsight Connect for life-threatening situations.
Availability
We aim for 99.9% uptime, but no service is perfect. We may need to perform maintenance, and outages can happen. We'll communicate planned downtime in advance.
SMS/MMS Program Terms
These terms govern text messages sent through Broadsight Connect to your phone number. By opting in, you agree to these terms.
What the program is
- Resident & Leasing lines: you text requests or inquiries to a property's designated number, and the automated agent or property staff replies and sends status updates, appointment confirmations, or property notices.
- Maintenance Specialist lines: if you are a maintenance technician or specialist assigned work by a participating property manager, we send task dispatches, scheduling updates, and completion confirmations.
- Admin & Security: we send one-time passcodes and administrative notifications when you access or manage an account.
How you consent (opt-in)
You may opt in to receive text messages by any of these methods:
- Keyword / QR code — you scan a QR code or text an enrollment keyword (such as START) or initiate a text conversation with one of our lines
- Web form — you check the consent box in our portal, onboarding link, or web form
Consent is never a condition of purchasing any product or service.
Message frequency
Message frequency varies. In general, we send only a small number of messages per week, and only in response to your requests, work assignments, or account activity. One-time passcodes are sent only when you request them.
Opting out
Reply STOP to any text message to opt out of future texts from that line. You will receive one confirmation message that no further messages will be sent. To re-enroll later, reply START. For help, reply HELP or contact us at legal@broadsight.io.
Account closure and number release
If the organization operating a Broadsight Connect line closes its account, cancels its subscription, or is deactivated, that phone number is released back to the carrier pool at the end of the active service period and Broadsight Connect will no longer send or receive messages on that line.
Costs
Message and data rates may apply depending on your carrier and plan.
Carrier disclaimer
Carriers are not liable for delayed or undelivered messages. Wireless carriers are not responsible for undelivered messages.
Indemnification
You agree to indemnify, defend, and hold harmless Broadsight LLC and its officers, employees, and service providers from any claim, demand, regulatory penalty, loss, or liability (including reasonable attorneys' fees) arising out of:
- your failure to obtain or maintain required consents from residents, leads, maintenance specialists, or callers under the TCPA, CTIA guidelines, or applicable federal or state telemarketing, messaging, or call-recording laws,
- your mismanagement, misuse, or unauthorized disclosure of call recordings, transcripts, or personal data handled through the service,
- any dispute between you and a maintenance specialist, vendor, or resident regarding work orders, services performed, or invoice payout amounts you authorize, or
- your breach of these terms or applicable law in connection with the service.
This clause does not cover claims arising solely from Broadsight LLC's own gross negligence or willful misconduct.
No Warranties
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated responses will be accurate or complete. Always verify critical information.
Payments and Billing
Subscription Plans and Billing Cycle
Paid subscriptions are billed monthly on the anniversary of the date you activate your paid plan (your "Renewal Date").
- Plan Fees (Billed in Advance): Each monthly billing period's base subscription charge is calculated from the number of active units in your account directory on the period start date (plus prorated charges for units added mid-period), subject to your selected plan's monthly minimum.
- Metered Usage (Billed in Arrears): Usage beyond your plan's included monthly allowances — including additional text message blocks and technician invoice payout runs — is tallied at the close of each monthly period and billed on the following period's invoice.
Invoicing and Payment Terms
When you first select a paid plan (or upgrade plans), the initial period charge is due immediately. For each subsequent monthly renewal, we generate a numbered PDF invoice on your Renewal Date and email it to your billing contact. Renewal invoices are due fifteen (15) days after the invoice date (Net 15). You may pay an open invoice at any time in the Billing portal; otherwise, any unpaid balance is automatically charged to your saved payment method on the due date.
Saved Payment Method and Recurring Charge Authorization
By providing a credit card, debit card, or bank account, you represent that you are authorized to use that payment method and you authorize Broadsight LLC (and our payment processor) to store your payment credentials on file and automatically charge them for: (a) your initial subscription activation, (b) each monthly renewal invoice on its due date, and (c) any plan upgrade or manual invoice payment you initiate, until you cancel your subscription.
Plan Changes
- Upgrades: If you upgrade to a higher plan tier mid-cycle, the new plan features take effect immediately and your payment method is charged a prorated amount for the days remaining in your current billing period.
- Downgrades: If you downgrade to a lower plan tier, you keep your current plan's features through the end of your current paid billing period, and the lower plan and rate take effect on your next Renewal Date.
Cancellation and Refund Policy
You may cancel your subscription at any time from the Billing section of the portal or by emailing billing@broadsight.io or legal@broadsight.io. When you cancel, your subscription remains active through the end of your current paid billing period and will not renew for the next period. All fees are non-refundable, and we do not provide refunds or credits for partial months, unused text or payout allowances, or mid-period unit reductions.
Late Payments, Suspension, and Number Release
If a scheduled charge is declined or an invoice remains unpaid past its due date, your account enters a 7-day grace period and we will notify you to update your payment method. If payment is not completed before the grace period expires, your account will be deactivated (suspended): call and message handling will stop, and any phone numbers and lead mailboxes provisioned for your account will be permanently released back to the carrier pool and cannot be recovered. Deactivation does not relieve you of the obligation to pay accrued invoices.
Taxes
Fees are stated exclusive of applicable sales, use, or telecommunications taxes. Where required by law, applicable taxes will be calculated and added to your invoice.
Data, Privacy, and Deletion Rights
Service Provider Role (CCPA / State Privacy Laws)
With respect to personal information of your residents, prospective leasing leads, callers, and maintenance specialists ("Customer Data"), you act as the "Business" (or data controller) and Broadsight LLC acts as your "Service Provider" (or data processor) as defined under the California Consumer Privacy Act (CCPA) and comparable U.S. state privacy laws. We process Customer Data solely to provide, maintain, and secure the Broadsight Connect service on your behalf:
- We collect only what we need to provide the service, and call recordings and transcripts are stored securely
- We do not "sell" or "share" (for cross-context behavioral advertising) your data or Customer Data
- We do not retain, use, or disclose Customer Data for any commercial purpose other than providing the services specified in these terms
- We do not use Customer Data to train third-party foundation models
Resident and End-User Deletion Requests
Because we process Customer Data on your behalf, residents or callers seeking to exercise privacy rights (such as a CCPA request to know or delete) should direct their request to you as the property manager. If a resident submits a request directly to us, we may refer the request to you or process it in accordance with your instructions. When you instruct us to delete a resident's or caller's personal data (via the portal or by emailing privacy@broadsight.io), we will scrub their personal identifiers, call recordings, and transcripts from active systems within 30 days.
Right to Wipe Customer Data
At any time during your subscription or after closing your account, you may request a full wipe of your account's Customer Data by contacting privacy@broadsight.io. Once verified, we will permanently delete or de-identify your properties' call recordings, transcripts, message histories, and contact records from our active databases within 30 days.
Statutory Retention Exceptions
Notwithstanding a resident deletion request or an account data wipe request, we retain records required for legal compliance and defense as permitted by law (including Cal. Civ. Code § 1798.105(c)–(d)):
- Consent and Opt-Out Ledger: SMS/MMS opt-in and opt-out timestamps and a cryptographic suppression record of erased phone numbers (to prevent re-contact and demonstrate TCPA/CTIA compliance)
- Financial Records: Subscription invoices, payment histories, and technician payout ledger records required for tax, accounting, and dispute resolution
- System Backups: Residual encrypted copies in automated disaster-recovery backups, which are overwritten automatically at the end of our standard backup retention window (up to 35 days)
See our Privacy Policy for full details.
Account Closure, Number Release, and Termination
You can cancel your subscription or close your account from the portal or by contacting legal@broadsight.io:
- Subscription Cancellation: If you cancel a paid subscription, your account remains active through the end of your current paid billing period. At the end of that period (or at the end of an expired trial and grace window), your account is automatically deactivated.
- Number and Resource Release (Irreversible): Upon account deactivation or closure, all phone numbers, SMS/MMS messaging registrations, and lead intake mailboxes provisioned for your account are permanently released and returned to the carrier inventory. Once released, a phone number can be reassigned to another party and cannot be recovered or ported out.
- Termination for Cause: We may suspend or terminate your access immediately if you materially breach these terms (including Acceptable Use or messaging consent requirements), and we'll tell you why. Upon termination, your right to use the service ceases and any unpaid fees for services rendered remain due.
Limitation of Liability
To the maximum extent permitted by law, Broadsight Connect's total liability arising out of or related to these terms or the service shall not exceed the greater of $100 or the fees paid by you in the twelve (12) months preceding the claim. In no event shall Broadsight Connect be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, property damage, or data loss, even if advised of the possibility. This section does not limit liability for our gross negligence, willful misconduct, or where prohibited by law, and does not affect your statutory rights.
Governing Law and Venue
These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Atlanta, Georgia for any matter not subject to arbitration.
Arbitration and Class Action Waiver
Any dispute arising out of or relating to these terms or the service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules, before a single arbitrator in Atlanta, Georgia. YOU AND BROADSIGHT CONNECT AGREE THAT EACH MAY BRING CLAIMS ONLY IN ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You may opt out of this arbitration provision within 30 days of first accepting these terms by emailing legal@broadsight.io.
General
- Severability — if any provision of these terms is unenforceable, the remaining provisions stay in effect.
- No waiver — our failure to enforce a provision is not a waiver of it.
- Assignment — you may not assign these terms without our consent; we may assign them.
- Entire agreement — these terms, together with the Privacy Policy, are the entire agreement between you and Broadsight Connect.
- Notices — notices to Broadsight Connect go to legal@broadsight.io.
- Third-party links — the service may link to third-party websites or services; we are not responsible for their content or practices.
- Force majeure — we are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, power outages, carrier or internet outages, or acts of government.
Changes to These Terms
We may update these terms from time to time. When we publish a new version, we will update the "Last updated" date at the top of this page, and if the changes are material, we will notify you by email at the address associated with your account at least 30 days before the changes take effect. Continued use of Broadsight Connect after the updated terms take effect constitutes your acceptance of the updated terms. If you do not agree to the updated terms, you may cancel your subscription before they take effect.
